Acceptance of Terms
By accessing or using Exoden ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
These Terms apply to all visitors, users, and others who access or use the Service.
Description of Service
Exoden is a web application designed to help invertebrate hobbyists track and manage their collections. The Service allows users to record animal information, feeding logs, molt events, and other husbandry data.
User Accounts
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the email account that you use to access the Service and for any activities or actions under your account with us.
User Responsibilities
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- Use the Service in any way that violates any applicable law or regulation
- Attempt to interfere with, compromise the system integrity or security, or decipher any transmissions to or from the servers running the Service
- Upload or transmit viruses or any other type of malicious code
- Use the Service to store or transmit content that infringes on the rights of others
- Impersonate or attempt to impersonate another user or person
- Use automated means (bots, scrapers) to access the Service without our express written permission
Intellectual Property
The Service and its original content (excluding content provided by users), features, and functionality are and will remain the exclusive property of Exoden and its licensors.
You retain ownership of any data you upload to the Service (such as animal records, photos, and notes). By uploading content, you grant us a limited license to store, process, and display that content solely for the purpose of providing the Service to you.
Data and Content
You are solely responsible for the data and content you upload to the Service. We do not claim ownership of your data, and you may export or delete your data at any time.
We perform regular backups and implement security measures, but we cannot guarantee that data loss will never occur. We recommend periodically exporting your data as an additional precaution.
Payment Terms
Certain features of the Service may require payment. You agree to pay all fees associated with your selected plan. All fees are non-refundable except as required by law or as explicitly stated otherwise.
We reserve the right to modify our pricing at any time. Any price changes will be communicated to you in advance and will not affect your current billing period.
Service Availability
We strive to maintain high availability of the Service but cannot guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We will make reasonable efforts to notify users of planned maintenance in advance.
Limitation of Liability
In no event shall Exoden, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Any content obtained from the Service
- Unauthorised access, use, or alteration of your transmissions or content
Disclaimer
The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Termination
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or contact us to request account deletion.
Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
